    The first step is a detailed project description, the single most important factor in a smooth, efficient review. Your consultant helps draft it, then identifies the potential impact areas to assess.

    Impact scoping

    An Initial Study evaluates potential impacts across resource categories: aesthetics, air quality, biological and cultural resources, geology and soils, greenhouse gas, hazards, hydrology, noise, transportation, tribal cultural resources, and wildfire.

  3. CE · EA / FONSI · EIR / EIS

    Determination

    Findings are summarized for public decision-makers to set the level of review: a Categorical Exemption, an Environmental Assessment leading to a FONSI, or a full EIR (CEQA) / EIS (NEPA).

    Public review

What is CEQA, and does my project need it?

The California Environmental Quality Act (1970) requires state and local agencies to analyze and publicly disclose the environmental impacts of proposed projects and adopt feasible measures to mitigate them. CEQA applies when an activity meets the criteria for a "Project": any public or private activity requiring discretionary approval or a permit from a public agency. Certain low-impact project types are specifically exempt. If your development requires discretionary agency approval, it likely needs CEQA review.

How does NEPA differ from CEQA, and when does it apply?

The National Environmental Policy Act (1970) is the federal law requiring federal agencies to evaluate the environmental effects of their actions, and it laid the foundation for CEQA. NEPA applies to any activity that receives federal funding, is undertaken by a federal agency, or requires a federal agency permit, including projects on tribal lands. In practice NEPA is narrower than CEQA, and many California projects trigger both.

What is a CEQA Initial Study?

When an activity qualifies as a "Project" and isn't exempt, an Initial Study evaluates its potential impacts across resource categories, including aesthetics, air quality, biological and cultural resources, geology and soils, greenhouse gas emissions, hazards and hazardous materials, hydrology and water quality, noise, transportation, tribal cultural resources, and wildfire. The findings are summarized in a report shared with public decision-makers to determine the appropriate level of further review.
